Arbitration / Damage Dispute Board
An Underground Facilities Damage Dispute Board has been established according to Utah state law law 54-8a-13.
This board is created to arbitrate a dispute arising from a facility owner’s or an excavator’s violation of Title 54, Chapter 8a – Damage to Underground Utility Facilities in the Utah State Code, familiarly known as “The Blue Stakes Law”.
This page has been created to educate both excavators and facility owners regarding this damage dispute board and enables a party to start the process of arbitration, even though Blue Stakes has no role in enforcement of the law or administering this board.
By filling out and submitting the from below, an email will be sent to the Public Service Commission who will consider this a written request for arbitration. The requester will also receive a copy of the email that was sent to the PSC. Once received, the Public Service Commission will reach out to the reporter/requester for more information and to schedule the board to meet to arbitrate the dispute, if applicable.
